What Is Probate?
Traditionally, probate is the formal court process through which estate assets are gathered and managed, taxes and debts are paid, and the estate is distributed under the supervision of the probate court. In addition to dealing with the assets of the deceased, court proceedings can involve the administration and care of children or individuals who are physically or mentally incapacitated.
Not all situations warrant the full, formal probate process from beginning to end. There are expedited procedures available – Waiver of Administration procedures for common family situations, and Summary Administration procedures to efficiently conclude estate administration. An estate may qualify for one or both of these expedited and less costly procedures through careful planning – planning that may include use of trusts, transfers, or beneficiary designations that by-pass probate processes.
There are situations when court supervision can be beneficial or advisable in the administration of an estate. Formal probate is often required in complex family situations, when there are substantial assets, or by default. As the adage goes, “making no decision is, in itself, a decision.”
